1. Acceptance of terms

These Terms & Conditions govern your access to and use of the BrightValley Link website at brightvalleylink.com (the “website”). By accessing or using the website, you agree to be bound by these terms. If you do not agree, please do not use the website.

2. About the service

BrightValley Link is an independent Australian editorial and research publication about cycling and active mobility. We publish articles, guides, illustrations and interactive features for general educational and informational purposes.

We are not a store, a booking service, a navigation or mapping application, or a transport operator. We do not sell goods, take bookings, provide live navigation, or move people or freight. Any maps, route names, diagrams, difficulty grades and planner tools are illustrative examples, not operational services.

3. Rider safety & accuracy disclaimer

Ride safely — our content is illustrative

The maps, route names, diagrams, difficulty grades and planner estimates on this website are illustrative only. They are not navigation, not survey data, and not a guarantee that any route, surface or condition exists as shown.

You are responsible for your own safety. You must obey all road rules, follow all signage and traffic control, wear a helmet as required by law, ride within your ability, and assume all risk associated with cycling and active mobility.

Road rules, e-bike power and speed limits, and helmet laws vary by state and territory. Always confirm the current rules and any route conditions with your local transport or road authority before you ride.

Before relying on anything published here, check current, official and local sources. We are not responsible for any loss, injury or damage arising from reliance on our content.

4. No warranties / accuracy

The website and its content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we make no representations or warranties of any kind, express or implied, about the accuracy, completeness, reliability, currency or suitability of the content for any purpose. Information may become out of date, and infrastructure, conditions and laws change.

5. Limitation of liability

To the maximum extent permitted by law, BrightValley Link and its contributors are not liable for any direct, indirect, incidental, special or consequential loss or damage arising out of or in connection with your use of, or inability to use, the website or its content.

Your Australian Consumer Law rights

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited to the maximum extent permitted by law.

6. Intellectual property

All content on the website — including text, articles, illustrations, diagrams, graphics, logos and the BrightValley Link name — is owned by us or our licensors and is protected by copyright and other intellectual property laws. You may view and share links to our content for personal, non-commercial use. You must not reproduce, republish, adapt or distribute our content without our prior written permission, except as permitted by law.

7. User submissions licence

If you send us feedback, suggestions, photos, route notes or other material (a “submission”), you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit and publish that submission in connection with our publication. You confirm that you own or have the right to share the submission and that it does not infringe anyone else’s rights. Please do not send us anything confidential.

9. Acceptable use

When using the website, you agree not to:

  • use it for any unlawful purpose or in breach of these terms;
  • interfere with, disrupt or attempt to gain unauthorised access to the website or its systems;
  • copy, scrape or harvest content except as expressly permitted;
  • misrepresent your identity or impersonate any person or organisation; or
  • upload or transmit anything harmful, misleading, infringing or unlawful.

10. Governing law

These terms are governed by the laws of the State of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts competent to hear appeals from them.
